Payments

Booking fee is £300. You can split this into 3 x £100 instalments.

Wedding Photography Services Agreement


Terms and Conditions

With regard to this document, "photographer" refers to Martin Carter Photography. The term "client" refers to the persons specified as Partner 1 and Partner 2 on the booking form.


Payments

The booking fees, once paid at the time of booking, are non-refundable. The remaining balance must be settled 60 days prior to the ceremony date. Any extra services or products will incur charges at the photographer's current rate.


All payments specified in the contract must be made by their respective due dates, and once made, they are non-refundable. The contract will be considered in effect only upon receipt of the booking fee. The photographer retains the right to cancel the agreement without additional correspondence if the payment is not received within one week of signing. Payments can be submitted via BACS. Failure to adhere to the payment schedule may lead to the cancellation of this wedding contract.


On The Day

It is acknowledged that Martin Carter Photography will serve as the exclusively contracted photographer for the commission outlined in the wedding contract. The photographer's work on any wedding day commences no earlier than two hours before the ceremony and concludes no later than 9:00 p.m., unless alternative arrangements have been made through booking.


If the duration of the services provided by the photographer is anticipated to exceed 5 hours, the client is required to provide a meal for the photographer and photography staff (including employees, assistants, or other individuals engaged by the photographer to assist with the services). Alternatively, the client will be responsible for covering reasonable meal expenses, and the photographer will furnish an invoice for reimbursement.


Cancelation

Cancellations can only be executed through written correspondence via letter or email. Should the client choose to cancel the booking up to six months before the specified wedding date on the booking form, the client shall forfeit the booking fee. In the event of cancellation within the final six months prior to the specified wedding date on the booking form, the remaining balance becomes due immediately and must be settled within seven working days.


Licence, coverage, and reproduction.

The photographer will strive to achieve a pleasing colour balance but cannot assure precise colour matching due to unusual reflectance caused by a combination of specific dyes and materials, especially man-made fibres. Capturing the exact color as perceived by the human eye can be challenging, whether on film or digitally.

By accepting the terms of the contract, the client acknowledges familiarity with the current style of the photographer. Any specific key shots required must be communicated to the photographer, although their guarantee is subject to circumstances on the day, including weather conditions and the cooperation of guests. Additionally, the photographer cannot be held responsible for any limitations imposed by the ceremony staff or venue.


Archive

The photographer will make an effort to retain images for a minimum of one year from the commission date. However, no guarantee is provided, considering the potential risks of technology failures, fire, flood, etc. It is essential that, upon receiving the link, you promptly download and backup the images. The photographer disclaims any responsibility for image storage beyond the contracted term mentioned above. Should you need access to the photographs after a one-year period, a £100 archive fee is applicable for retrieval, provided the images are still available.


Rescheduling

In the event that the client wedding needs to be rescheduled for any reason, and if the photographer is available on the new date, the remaining balance must be settled in full before the transfer.


Consents

The client will ensure that all required consents, as applicable, have been obtained prior to the performance of the services, including any consents required for the performance of services and the delivery of work products by the photographer and, as applicable, from venues or locales where the services are to be performed or from attendees of the wedding.


Pre-Wedding Shoot with Optional Guest Book

The pre-wedding shoot (PWS) will take place in and around Christchurch, Dorset. It is your responsibility to select the required number of photographs for the guest book and notify us in a timely manner—no later than two months before your wedding date. If we do not receive your selection within this period, we will be unable to arrange the production of the guest book, and the product will be forfeited.


Please note that we accept no responsibility for any damage to or caused by the guest book on the wedding day. The guest book is provided “as is,” and its use is entirely at your own risk.


Album Production and Delivery

Once the wedding album enters production, the estimated lead time is 6 to 10 working weeks. All wedding albums are shipped directly from the manufacturer at no extra cost and delivered via courier.


Unforeseen Circumstances:

The successful execution of this contract may be affected or called off by either party due to uncontrollable factors. In the rare occurrence of a complete photographic failure or cancellation initiated by either party or under any unforeseen circumstance, the liability of one party to the other will be restricted to the total contract value. Neither party will be held responsible for indirect or consequential losses.


Copyright

The client gives the photographer unrestricted use of the images in accordance with the Copyrights, Designs, and Patents Act 1988, along with subsequent amendments. However, the photographer will make every effort to avoid using any image in a manner that could cause distress, embarrassment, or negative consequences for the client.


The Copyright, Designs, and Patents Acts assign the copyright of the images to the photographer.

The contract terms outlined above specify that the photographer maintains full copyright, unless otherwise specified. The photographer has the right to utilise any commissioned images across various media for advertising, trade, self-promotion, and other lawful purposes, including competition entries and exhibitions. Reproduction of images is not restricted.


However, rights pertaining to reproduction and storage are confined to the named client and are non-transferable without additional agreement and an appropriate fee. The provided images are intended for the client's private use. While they may be used for newspaper or magazine articles, etc., the photographer must be credited. The images should not be used for commercial purposes.


Copyright Statement:

The photographer retains copyright over all photographs captured during your wedding day, and all associated computer files remain our property. However, the photographer is pleased to provide the client with a copy of professionally edited photographs from the client wedding day for personal, non-commercial use. All images supplied will be non-watermarked and of high resolution, ensuring the client can cherish and share memories without limitations.


Accidental Damage & Personal Injury Disclaimer

While the photographer endeavours to ensure the safety of each directed photoshoot, the photographer cannot accept liability for any accidental damage or personal injuries. By engaging in each photoshoot, the client acknowledges and accepts the inherent risks involved and undertakes the session at their own discretion and responsibility.


Travel Costs and Accommodation

The photographer would like to establish an agreement on travel charges beforehand. The cost of travel within the UK is set at 45 pence per mile. However, travel expenses for weddings within 20 miles of Bournemouth are complimentary.


In cases where the photography location is situated at a distance exceeding 100 miles from the BH postcode, Martin Carter Photography may necessitate accommodation. Should it be deemed necessary to travel to the photography location the evening before the scheduled shoot, particularly in instances such as late-running weddings, the client shall bear the cost of accommodation. Any accommodation arrangements must be confirmed with Martin Carter Photography prior to booking.


Provision of food.

Two hot meals must be provided for the photographers at the same time as the wedding breakfast, preferably two bar meals if available at your venue.


Drone

The drone video shoot is subject to cancellation in the event of poor weather conditions, legal issues, or technical issues with the drone. In such cases, The Photographer will refund the appropriate fee as a voucher, which can be redeemed in our online store.


DISPUTE:

If the client has any complaints, they should initially communicate them in writing to the photographer within 30 days from the date of receiving the images. In the rare event of an unresolved complaint, the client may seek arbitration through The Societies of Photographers, depending on membership status.
